By using Sail Smarter Race Analytics — Single Boat Analysis or Tuning Partner Analysis — you agree to these terms. If you don't agree, please don't use the site.

Who we are

Sail Smarter Race Analytics (sail-smarter.com) is an independent project providing browser-based race-analysis tools for sailors using Vakaros or Velocitek instruments. We are not affiliated with, endorsed by, or connected to Vakaros or Velocitek in any way — "Vakaros", "VKX", "Velocitek" and "VTK" are used here only to describe file compatibility. All trade marks are the property of their respective owners.

What the service does

We provide the following tools:

• Single Boat Analysis — analyses a single boat's race file (.vkx or .vtk): track, speed, VMG, manoeuvres, wind and more.
• Tuning Partner Analysis — compares two boats' race files from the same race head to head.
• Video Overlay Analysis — plays your own onboard footage back with the instrument data drawn over it.
• Fleet and Event Analysis — compares a whole fleet in one race, either from files you hold yourself or from an event that several sailors have uploaded to.

They all run in your web browser, with the race analysis itself carried out securely on our server. Your race file is sent to us for processing and the results are returned to your browser — we don't store a copy of your file. Video Overlay Analysis additionally uses a video file from your own device; that video is never uploaded and never reaches us. See our Privacy Policy for more detail.

Accounts and access

To use the tools, you sign in. You're responsible for keeping access to that account secure, and for any activity that happens under it. You must be old enough to form a binding agreement in your country of residence to create an account.

Cost

The service is provided free of charge. There is nothing to buy and no account balance.

Acceptable use

Please use the service only for its intended purpose — analysing your own (or a consenting tuning partner's) sailing race data. You agree not to:

• Attempt to disrupt, overload, or gain unauthorised access to the service or other users' accounts or data.
• Use the service for any unlawful purpose.
• Upload someone else's race data to an event, or upload data you do not have the right to share.
• Redistribute, publish or sell another sailor's race data that you can see because you both entered the same event. It is shared with you for comparing your own racing, and nothing more.

We may suspend or close an account that we reasonably believe is being used in breach of these terms.

Your data and content

Your .vkx files and any results you generate remain entirely yours. We process your race file only to run the analysis you've requested, we don't store a copy of it once that's done, and we don't hold, control, or claim any rights over your race data.

Events work slightly differently, and only ever with your explicit agreement. If you tick the box to upload a race to an event, you are giving the other sailors in that event permission to see that race — your boat name, sail number, track and the figures derived from them — so that everyone entered can compare their racing. The race stays yours; you are granting a limited permission to view it, not transferring anything to us. Your original file is still not kept, and your email address is never shown to anyone. You can ask us to remove your race data from an event at any time. See the Privacy Policy for the full detail of what is shared and with whom.

Intellectual property

The Sail Smarter Race Analytics website, tools, and underlying code and design belong to us (or our licensors) and are protected by copyright and other applicable laws. You're welcome to use the tools for their intended purpose and to keep or share the analysis files you generate, but you may not copy, reverse-engineer, or redistribute the tools themselves without our permission.

No warranty

The tools are provided "as is." Race analysis — including speed, VMG, wind, manoeuvre, mark-rounding and start-line calculations — is derived from your instrument's recorded data and involves estimation and interpretation; it's provided for informational and coaching purposes and we don't guarantee it's complete, accurate, or free of errors. We don't warrant that the service will be uninterrupted, error-free, or compatible with every VKX file or device.

Limitation of liability

To the fullest extent permitted by law, we aren't liable for any indirect, incidental, or consequential loss arising from your use of the service, or for decisions made in reliance on the analysis it produces. Nothing in these terms excludes or limits liability where it would be unlawful to do so (for example, liability for death or personal injury caused by negligence, or for fraud).

Third-party services

The service relies on third parties — Google (sign-in), Supabase (authentication and account storage), Cloudflare (hosting), and Web3Forms (contact form). Your use of those features is also subject to those providers' own terms and privacy policies.

Changes to the service or these terms

We may update these terms, or change, suspend, or discontinue any part of the service, at any time. Material changes to these terms will be reflected by an updated "last updated" date at the top of this page. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
